Aren't a fair number of those lawsuits about hardware patents and design patents?

Some of them are, yes. But my understanding is that the hardware patents are generally clearer, and more likely to be licensed (because they were out in plain sight).

Design patents I know less about (and see a point of only if they're to prevent the public from being defrauded through confusion).
