Arguably she doesn't have less agency than the male characters based on her gender, but almost all Shakespeare's major characters have at least interiority – he writes women as people pretty consistently. Few of them, any gender, have actual agency because they're all in the hands of fate, and he's also fairly realistic about women having less control over their lives than men. She makes choices, but they are very constrained choices, and if 13 is too young to be in an arranged marriage, it's also too young to really know that she wants to be with Romeo or indeed that she'd rather die than be sent to a convent.
