I'm convinced by this argument. Historical pardons should really be for things that should never have been illegal or for miscarriages of justice anyway.

I have a great deal of sympathy for David Allen Green's position.

There are also some legal positivist arguments for not pardonning or retrospectively quashing convictions for behaviour that is now legal.

There is an almost arbitrarily long list of people who were treated appallingly by the justice system, whether by being wrongly convicted or punished draconianly or being done for things that shouldn't have been criminal. As I understood it, the general view was that we recognised this and that in those cases the state was in the wrong and therefore there was no stain on their character. Some, indeed, have been literally regarded as martyrs.

I don't really see what we gain from moving to a view that only those who have been legally pardoned can be seen as having been wronged. The victims themselves, of course, are past caring.
