This is slightly more deranged than some of the stuff I see as a lawyer handling child contact disputes - but not by far.

It may also be the most spectacular violation yet of Facebook's term of service about the minimum age for an account being 13....

Well, I've seen plenty of FB (and Twitter) accounts for cats, plushies, assorted elder gods, etc. I've had at least one LJ account friended that was for a newborn child of a friend. So that didn't surprise me.

The two parents using it as a forum for continuing their arguments, on the other hand...

Presumably you could report that user to Facebook since a] they're not posting it themselves so either it's a fraudulent account or even if FB accepted it was being posted on their behalf, they're underage for FB.
