The toad whose venom is in question is described as being a rare species. Was there a conservation offence committed as well? Were endangered animals illegally killed?

The difference between action and identity is a very relevent one. "I am a musician" requires constant musical practice to keep being an accurate statement. Being a musician is not an identity that can be sustained in the absence of actually playing music.
