I propose that if you supply software to more than X customers (say 10,000 but I'm totally open to discussion on this point) then you must have insurance that covers you for legal liability for damages.

Which is to say, if your software causes you to be sued then your legal insurance will cover it - but they get to set your premiums. And if there's one thing that insurance companies are very good at, it's pricing risk.

So you can shop around for a good deal, they will absolutely want to look at your processes regularly to make sure you're not being a bunch of careless idiots, and everyone wins except for the for the shareholders/business owners/senior management who thought that cutting testing and good practices to the bone was a good idea.
