HES is a quintessential example of public sector obstructionism, and "health and safety gone mad", not just in this case. pathological risk avoidance rather than risk management. and that's coming from someone pathologically avoidant.

It does sound to me that throwing a chunk of money at mitigation plans might help. Needs a rich, high profile donor or three? Gotta be a few with enough interest, surely?
