There is no need for a specific criminal offence of abusing shop staff. At best it's magical legalism. At worse performance legislation.

I genuinely think it's worse that useless. It just chews up Parliamentary time making "ain't it awful, ain't it awful" noises and then leaves a confusing legislative trail behind it. David Allen Green has a good essay on magical legalism and it's unhelpfulness.

Meanwhile, if the police, shop owners and USDAW really wanted to deal with abuse by customers of shop staff they have all the legal tools they need, other than better employment rights.

So if Daniel Johnstone (a Labour MSP, A *LABOUR* MSP) really wanted to do something he'd legislate for e.g. mandatory 3 months off on full pay for any shop worker who was the victim of a second criminally abusive event in a twelve month period. That would focus the minds of shop owners about where the balance of risk, reward and responsibility lay for protecting their staff.

It'll be like the Dangerous Dogs Act - ill-thought out, harming people it's not meant to harm, and doing sod-all about the original problem.
