You can imagine that I was pretty surprised to have my friend Scott tell me that a local bar (Pivo) had promotional postcards that looked like this:



Tomorrow, I shall be going into town to find a solicitor and see if I have a case I can make....

You should be able to make a case on both copyright abuse (as the original is still recognisable in the new form), abuse of moral rights, lack of a model release and defamation of character to name but a few. I would reckon they will settle out of court. I have a book on photographic law if you want me to look up details....

Regardless of the intent (humorous or otherwise), I know that the British legal system is way, way harder on things like this than the US, especially if there is issue of libel involved. Sue. Even if there is no damage to your reputation, these numbnuts are using your image for promotion or gain and you were not notified or compensated in any manner.

And then when you are finished suing, I will hop the pond and punch the pub owner in the face.

Hahaa! Brilliant! What a bunch of amateurs they are. Your CV online says that you’re from Stirling! PIVO is overpriced and has shit atmosphere, for that reason I think YOU should collect a reward. Substantially more than $10 too.

you may get more of a responce by having a quiet chat with the bar owner, maybe suggest a few nights of free drinks, or are you going for 1000's compensation, one of those retorical questions...

but I'd expect you have attacks on two fronts, personal infringement, maybe not cos you posted them in the first placve, but cirtainly, the fact that they are sluring you, clearly telling the world your a bad boty, but also, you have copy right case, clearly.

it is your image, and is published by you, since they are using it for comercial purpopses, the normall resctriction lifts don't apply, like for education and that stuff..
