It'd be great if Apple did manage to patent spyware. The only people who would think that Apple would want to spy on their users are the anti-apple fanboys -- what would actually happen would be that Apple would use their patent(s) to fight spyware legally.

Ah - actually reading the patent it's actually not about what we'd normally call Spyware (I guess the EFF realise they'll get more traffic by using that term). It's some sort of security idea where you detect if a device is being used by an unauthorised user with a whole load of other random stuff tacked on.

The EFF talk about the patent as if it enables them to do these things, that's just classic scaremongering - anyone could do any of these things now, the patent (if it were a good implementable idea, which this clearly isn't) would just mean that only Apple could do it (well, other people would have to license such use from them).

Apple's patent: to the best of my [not very] awareness, the FBI can already pretty much do that. Without warrant. Not that I think Apple's patent is a good idea [I don't], just sayin
