Date: 2010-07-14 11:17 am (UTC)What particularly bugged them is that a transcript exists of the original plea bargain negotiated in the judge's chambers with Polanski's attorney and the District Attorney.
This transcript has been kept under seal for more than three decades - and there is a general assumption that the judge told Polanski that if he plead guilty he did his stint in the psychiatric hospital the judge would not send him to jail.
If so, the US Justice Department would have a strong incentive to keep that transcript sealed because it would make it impossible to sentence Polanski to any additional jail time.
And, to be honest, I can't think of any other reason why they would not provide that normally public document to Swiss authorities if it didn't completely undermine America's case to put him in jail.

Date: 2010-07-14 08:43 pm (UTC)Yes, I think Polanski should have gone to jail for what he did to that girl, but I also believe in the rule of law and subscribe to the "let 100 guilty men go free rather than convict one innocent man theory."
The thing is that by rejecting his extradition it will encourage the US justice system to prosecute other sex crimes the right way, rather than leaving gaping holes in their evidence path.
And let me tell you in an American citizen was sitting in New York and Germany wanted him extradited but didn't give us the proper paperwork we would have told Germany to fuck off as well.

On the other, we're talking about putting someone in a *US* prison, which is something civilised countries do not do, and we're talking about putting an old man who is a sex offender in a crime against a child who is *famous* in a US prison, which is even worse.
