We need a change in the law to specify that historical agreements for residual payments or requirements for permission will only apply where money is being made from the exhibition of the material, either directly (e.g. DVD sales), as part of a subscription arrangement (including e.g. Netflix but not the TV licence) or by advertising.

The article uses Dad's Army as an example of a program that the BBC owns but doesn't own all the rights to, and thus has limited ability to re-release. So what about Dr. Who? They seem to have gotten the back files of that one out.
